These Terms of Service ("Terms") are an agreement between you and Tech Artists ("we," "us," or "our") about your use of the Birdsong Match mobile game and related services (the "Service"). By downloading, installing or using Birdsong Match, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
In short: Birdsong Match is free to download and play, and every level can be finished without paying or watching an ad. There are no ads until you clear Level 10; after that a short ad may play between levels, rewarded ads are always your choice, and one optional purchase removes the ads between levels for good.
1. Eligibility
Birdsong Match is a general-audience game. If you are under the age of majority where you live, you need a parent's or guardian's permission to use the Service, and they accept these Terms for you. In-app purchases should be made by an adult or with an adult's permission.
2. Your license
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Birdsong Match on devices you own or control, for personal, non-commercial entertainment. You may not:
- Copy, modify, distribute, sell, lease or sublicense any part of the Service;
- Reverse engineer or decompile it, except where the law forbids this restriction;
- Use cheats, bots, exploits or unauthorized software with the Service;
- Use the Service in a way that breaks the law or these Terms.
3. Ads and in-app purchases
3.1 Free to play
Birdsong Match is free to download and play. All twenty levels and both sanctuaries can be completed without spending money or watching ads, and failed levels can be retried as often as you like at no cost.
3.2 Ads
- Ads between levels. No ads appear until you have cleared Level 10. After that, a short full-screen ad may appear after you leave a level's result screen. These ads are spaced out, never appear during a puzzle, and are removed by the Remove Ads purchase.
- Rewarded ads. When you run out of moves, or out of Hammers, the game may offer a short ad in exchange for five extra moves or one extra Hammer. Watching is always optional, and these offers stay available after Remove Ads.
Ads are served by Google AdMob, which may collect limited device and ad-interaction information as described in our Privacy Policy. We request non-personalized ads only.
3.3 Remove Ads
Remove Ads is a one-time, non-consumable in-app purchase that permanently turns off the ads between levels. It is not a subscription and does not renew. The price is shown in the store at the time of purchase and may vary by region. The purchase belongs to the Google account that made it and can be restored on another device signed in to that account with Settings › Restore Purchases.
Purchases are processed by Google through Google Play, subject to the Google Play Terms of Service. We never receive your payment details.
3.4 Refunds
Refunds and billing are handled by Google Play. You can request a refund from your Google Play order history. We do not process payments and generally cannot issue refunds on Google's behalf.
4. Your progress
Your progress is saved on your device. We do not keep a copy, so deleting the app or its data, or changing phones, may lose it. A Remove Ads purchase can always be restored from your Google account.
5. Intellectual property
Birdsong Match, including its artwork, audio, code, design and trademarks, is owned by Tech Artists or its licensors and protected by copyright, trademark and other laws. You may share screenshots and short gameplay videos for non-commercial purposes, crediting Birdsong Match / Tech Artists where reasonable.
6. Updates and changes
We may release updates, add or change features, or discontinue the Service. Some updates may be required to keep playing. We'll try to give notice of significant changes.
7. Third-party services
Birdsong Match uses Google Play (distribution and payments) and Google AdMob (ads). Your use of those services is governed by their own terms, and we are not responsible for their practices.
8. Disclaimers
BIRDSONG MATCH IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECH ARTISTS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25.
10. Indemnification
You agree to indemnify and hold Tech Artists harmless from claims, damages, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of anyone else's rights.
11. Termination
We may suspend or end your access to the Service if we believe you have violated these Terms. You may stop using the Service at any time by deleting the app.
12. Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Tennessee. If you are a consumer in the European Union or another place with mandatory consumer protections, nothing here overrides the rights your local law gives you.
13. Changes to these Terms
We may update these Terms. We'll change the "Last updated" date above, and communicate material changes in the app or on this website. Continuing to use the Service after a change means you accept it.
